These Terms of Service (“Terms”) are an agreement between you and Best Choice Reports (“Best Choice Reports,” “we,” “our,” or “us”) covering your use of bestchoicereports.org and related comparison tools we operate (together, the “Service”).

By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Best Choice Reports is a product comparison and referral website. We publish shortlists, rankings, and links so you can compare consumer products. We may use affiliate links, advertising networks, or embedded shopping tools from third-party partners and may earn a commission if you click through and purchase from a third party.

2. Third-party shopping, ads, and disputes

When you click a deal, search, or ad, you may leave our site or interact with a third-party checkout, marketplace, or advertising partner. Those parties’ terms, privacy policies, and customer-service rules apply to that transaction.

All purchase disputes are between you and the Merchant. That includes (without limitation) charges, refunds, shipping delays, product condition, safety, recalls, and warranty claims. You agree to contact the Merchant — not Best Choice Reports — for those issues. We have no obligation to mediate, reverse a charge, or compensate you for a third-party purchase.

Prices, photos, specs, and availability shown on the Service are provided for comparison only, may be delayed or incomplete, and may differ from what you see at checkout. A listing is not an offer by Best Choice Reports.

3. Affiliate and advertising disclosure

Some links, shortlists, and ads are affiliate or paid placements. We may update, reorder, or remove shortlists at any time. Prices, coupons, specs, images, and availability shown on the Service may be delayed, incomplete, or wrong relative to the Merchant’s checkout page—which controls the actual offer.

The Best Choice Reports name, logo, site design, and original content belong to us or our licensors. Product names, photos, and trademarks belong to their owners. You may not copy or reuse our materials for commercial purposes without permission.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, BEST CHOICE REPORTS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted access, accurate or current prices, availability, or that any third-party purchase will be honored.

Product quality, safety, and legality of a purchase are solely the Merchant’s and manufacturer’s responsibility.

12. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, BEST CHOICE REPORTS AND ITS OWNERS, OFFICERS, AND CONTRACTORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR PURCHASE COSTS, ARISING FROM: (A) YOUR USE OF THE SERVICE; (B) ANY PURCHASE OR PAYMENT WITH A MERCHANT; (C) ERRORS IN DISPLAYED PRICES OR LISTINGS; OR (D) ACTS OR OMISSIONS OF ANY THIRD PARTY.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) COMMISSIONS WE ACTUALLY RECEIVED FROM YOUR SPECIFIC CLICK-THROUGH IN THE 90 DAYS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limits; in those places, our liability is limited to the maximum permitted by law. Nothing in these Terms excludes liability that cannot be excluded (for example, fraud where such exclusion is illegal).

13. Indemnity

You agree to indemnify and hold harmless Best Choice Reports from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your purchases with Merchants, or your violation of these Terms or applicable law, except to the extent caused by our willful misconduct.

14. Third-party sites and tools

Ads, affiliate widgets, analytics, and outbound links are provided by others. We are not responsible for their content, uptime, tracking cookies, or data practices. Your use of those tools is at your own risk and subject to their terms.

15. Changes; termination

We may update these Terms at any time. The “Last updated” date will change when we do. Continued use after an update means you accept the revised Terms. We may modify or discontinue the Service without notice.

16. Governing law

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless a mandatory consumer law in your country of residence requires otherwise. You agree that courts located in Delaware have exclusive jurisdiction, except where prohibited. You and Best Choice Reports waive class actions to the extent allowed by law; claims must be brought individually.
